Governing Law and Dispute Resolution

You agree that any dispute, claim or controversy arising out of or relating to this Privacy Policy shall be settled by binding arbitration between you and LOH, and not in a court of law.  The arbitration will be administered by the American Arbitration Association (“AAA”) applying the law of the State of New York and in accordance with the AAA’s applicable Rules of Arbitration. Claims shall be heard by a single arbitrator. The place of arbitration shall be New York, NY. The arbitration shall be governed by the laws of the State of New York. Each party shall bear its own costs and expenses and an equal share of the arbitrator’s and administrative fees of arbitration. Except as may be required by law, neither a party nor an arbitrator may disclose the existence, content, or results of any arbitration hereunder without the prior written consent of both parties.

You acknowledge and agree that you are each waiving the right to a trial by jury or to participate as a plaintiff or class member in any purported class action or representative proceeding. Unless both you and LOH otherwise agree in writing, any arbitration will be conducted only on an individual basis and not in a class, collective, consolidated, or representative proceeding.
